2010/07/15 Technology: A Learning Curve

This past week has been filled with both high’s and low’s for ZAGlamour. We have unfortunately been schooled in the way of research and copy writing as we were confronted with an industry problem that seemed to have eluded us. Approximately three weeks ago, ZAGlamour commissioned a Viral Competition that involved having public viewers and South African models submit images and work they had done in order to be entered into a voting Competition. The winners of which would receive a “Public Profile” on the ZAGlamour website, which they could up date and post images to whenever they had finished a recent shoot. The opportunity was bountiful and many took up the challenge and submitted their images to the Competitions Folder for ZAGlamour.

Quite frankly, we were overwhelmed with the response the Competition received and considering we had all our ducks-in-a-row…(or so we thought)…we embraced the buzz and ran with the Competition, announcing 3 models as winners of the “Who Wants to be a ZAG Girl”? Competition. One of the models in particular has been in the industry for quite some time and we were more than happy to have her on board.

In the Submission details of the Competition, ZAGlamour CC clearly stated that we required all photographers’ details, additional studio where images were shot or additional details that accompany each image submitted for the Competition itself. Caught up in the heat of the moment, there was one detail, which we as a company over-looked and unfortunately have had to “pay the price” for, so-to-speak. What we, as a company and Editorial Team, were not aware of was that an image we used to promote one of the winners of the “ZAG Girls” Competition was commissioned by another publication entirely. Stating on the Submission Details of the Competition that we required full details of the photographer and associated studio’s, we neglected to mention and request for “Prior Usage of Image for Publication in either the media of print or online” [Para. (c) substituted by s. 1 (a) of Act No. 66 of
1983] which states; [“artistic work” means, irrespective of the artistic quality thereof - (a) paintings, sculptures, drawings, engravings and photographs;] – So, in light of the following, we were unfortunately in breach of the use of the image, 1) without consent of the rightful owners and 2) reproducing the image in our own capacity without giving full accreditation.

Panic struck as I was contacted by the rightful owners of the image – Locally Whipped Magazine – a rocking South African magazine who’s core focus is the extreme and alternative sporting world of South African mixed with good ol’ South African models and the like. Straight away I explained to the Locally Whipped team that I was completely unaware of the fact that the image in question was in fact, commissioned by them directly. As Editor-in-Chief at ZAGlamour, this was my responsibility to have checked, double-checked and re-checked the true source of the image. I would like to formally apologise to the crew at Locally Whipped for not be aware of the images rightful ownership and in the same breath, would like to thank them for their understanding in the matter as it was resolved amicably.

What has this incident taught us here at ZAGlamour? Well, it truly goes to show that not matter how secure you believe a Competitions guidelines are, one must always take into consideration a 3rd party interest and true copy written source of an image.
